Too much appears to turn upon the primary/secondary victim distinction, and the restrictive approach to actions of secondary victims has led to unjust results. WebPreviously, the test was whether psychiatric injury is reasonably foreseeable. After Page v Smith, for primary victim, foreseeability of physical harm is sufficient. Secondary victim however still requires foreseeability of psychiatric injury. As such, it is important to distinguish between a primary victim and a secondary victim.
